A SPEAKER'S POWERS.
NON-EXISTIXG OUTSIDE THE HOUSE. By Cable—Press Association—Copyright Received 17, 7.30 p.m. Sydney, November 17. The Full Court uphold the demurrer raised by plaintiff in the case of Perry, a member of the Assembly, against Speaker Willis and the Sergeant at Arms for assault and wrongful imprisonment, arising out of the recent scenes in the Assembly.
Defendants pleaded not guilty, and that any action taken was for the purpose of preserving order and maintaining the Standing Orders. Plaintiff's second plea claimed that there was no justification for being brought back to the House in custody and detained.
The Court held that the speaker was merely acting as chairman of a meeting, and had no positive power. The cause of disorder having been removed on plaintiff leaving the House, the. Speaker had no power to bring him back, which Justice Pring characterised as an extraordinary deprivation of a man's liberty.
