MOKAU JONES ESTATE.
ALLEGED BREACH OP CONTRACT. By Telegraph.—Press Association. Wellington, Lost Night. The affairs of Joshua Jones, of Mok» farmer, were before the Chief Justice t, day, when his counsel (Mr. E. G. Jellicoe mentioned a claim of £IOO,OOO preferred by Mr. Jones against the executors of Wickham Flowers. Counsel maae a very long statement,, reviewing the history of the estate. The executors, »$ said, had an attorney in New Zealand, and he desired to take proceedings. Sora? of the property, he said, was sold tp Herman Lewis .for £14,000; but he questioned this sale, and plaintiff claimed redemption of his property. His Honor said that, if there had beea a breach of contrast in England, counsel could not proceed in New Zealand, but Mr. Jellicoe disagreed with this. His Honor pointed out that the Full Court (five judges) had held that the sale was a proper one, and he must be guided by them. Plaintiff was met by this bar in law, and he thought plaintiff could not claim damages in this country, as he was asking the Supreme Court of New Zealand to issue a writ against persons in England, where the contract was made and broken. Mr. Jellicoe said he had been told by a Chancery Judge in England that be could sue in New Zealand. His Honor said he would try and deliver judgment on Thursday morning.
