A CONVICTION QUASHED.

By Telegraph.—Press Association. Wellington, Last Night. In the case Rex v. Smith, before the Appeal Court to-day, a prisoner named John William Smith had made a written declaration of the loss of a pawn ticket under the Justices of the Peace Act The words, "and by virtue of the justices of the Peace Act," which ought to have followed, were omitted. The jury convicted him of making a false declaration, and the Court was now asked to determine whether the declaration was valid. The Court held that as an essential part of the prescribed form had been T . ' Jt wns " ot " declaration under the Act, and as accused had been convicted of .making a false declaration under the Act, the conviction must be quashed.
