Captain Xaylor, of the Penguin, has appealed against the Court's finding, on the ground that it has not proved that the casualty was due to hi-, negligence or default; or that under the eircuni.stanees shelter should have been sought; or that the vessel's head should have been put to sea; also that it was not proved Unit the master was guilty of a breach of the rules for preventing collisions at sea; or Unit soundings should have been taken; that there was no evidence to show that the steamer did not strike an uncharted rock or a wreck; and generally that there was no evidence warranting the Court in suspending the master's certificate.
