CAPTAIN XAYLOR'S APPEAL. By Telegraph.—Preßs Association. Wellington, March 13. Captain Xaylor, of the Penguin, has appealed against the Court's finding, on the ground that it has not proved that the casualty was due to hi-, negligence or default; or that under the eircuni.stanees shelter should have been sought; or that the vessel's head should have been put to sea; also that it was not proved Unit the master was guilty of a breach of the rules for preventing collisions at sea; or Unit soundings should have been taken; that there was no evidence to show that the steamer did not strike an uncharted rock or a wreck; and generally that there was no evidence warranting the Court in suspending the master's certificate.
