Defendant did not deny the transaction, but counsel relied 011 section 361 of the Mining Act, 11)05, prohibiting the secretary of a mining company acting as a sharebroker, also the non-compliance 01 the buyer with section 3 of the Stamp Act, 11102, in issuing a buver's note without authority. Hie building contained 40 barrels of tallow cio barrels of which were saved), a quantity of soap and resin, also jnitichinery and plant, the whoto with the buildings being valued at £IOOO. The conflagration is supposed to nave originated in the vicinity of the boiler. the lire of which was left banked up as usual for the night, at 10.30 oeloek tiro previous evening. When the outbreak was discovered bv Mrs. Downer, t lie portion of the building near the boiler was all ablaze, and the firm hold which tile fire had obtained made it an impossibility to suppress the flame*.
