TARANAKI HOTEL CASE

JIE-HEAIUMG Al'l'UlSD FOK. In the -Magistrate's Court yesterday afternoon, before Mr. 11. S. Fitzherbert, S.M., an application for u re-ilicaring of the case Police v. George Jjishop, charged with -permitting itrimkemvess on licensed premises, to wit, the Tarauaki Hotel, was manie by Mr. (Juilliam oh behalf of the Crown. The application was made on the ground that further evidence had been obtained tliat could not be adduced at tlie time tilt ease was hoard.

His Worship said that he could not grant such aa application uuless he had before him ailidavits of tlie witness or witnesses showing that fresh evidence had been obtained, in order that he could judge whether it would be likely to all'ect his previous decision and whether ordinary diligence had been used in obtaining evidence at tho original hearing. ill - . Quilliam stated that he would call Sergeant lladdivlt to give evidence lo show that due diligence had been used in collecting evidence. As Lhe defence had made much of the fact that tho barmaid could not lie found and that She could have given evidence in favor of the defence, he realised that she ivas an important witness. A signed statement had been obtained from this woman.
