TARANAKI HOTEL CASE
JIE-HEAIUMG Al'l'UlSD FOK. In the -Magistrate's Court yesterday afternoon, before Mr. 11. S. Fitzherbert, S.M., an application for u re-ilicaring of the case Police v. George Jjishop, charged with -permitting itrimkemvess on licensed premises, to wit, the Tarauaki Hotel, was manie by Mr. (Juilliam oh behalf of the Crown. The application was made on the ground that further evidence had been obtained tliat could not be adduced at tlie time tilt ease was hoard.
His Worship said that he could not grant such aa application uuless he had before him ailidavits of tlie witness or witnesses showing that fresh evidence had been obtained, in order that he could judge whether it would be likely to all'ect his previous decision and whether ordinary diligence had been used in obtaining evidence at tho original hearing. ill - . Quilliam stated that he would call Sergeant lladdivlt to give evidence lo show that due diligence had been used in collecting evidence. He would then ask his Worship to adjourn the application to enable liim to obtain aa Viltidavil from t'hu lresh witness.
.Mr. drey objected to this course .being adopted. Ills Worship pointed out that Mr. yuilliatii was in order in adopting it.
S.'rgt. lladdrell gave evidence that at the time of the trial he had uo knowledge of tho wlieronlwuU of Mary O'Donuell. who had been employed as barmaid at Uie Tarauaki Hotel on the date of the, alleged olleucc. Knowledge of her whereabouts had come to liim casually. As Lhe defence had made much of the fact that tho barmaid could not lie found and that She could have given evidence in favor of the defence, he realised that she ivas an important witness. A signed statement had been obtained from this woman.
Mr. Quilliam then formally applied for an adjournment. .Mr, (Irev further objected at length to .file proceedings, lie laid great stress (in Pile way in which the matter was dragging mi and had dragged on before lhe trial.
Mis' Worship granted Mr. Quiliiam's application lor an adjournment, the nllidavit to lie laid U'foi'e him on the inst., al 10.-'O a.ni.
