The Appeal Court granted leave to appeal to the Privy Council in the case the Public Trustee versus the Commissioner of Stamps. In the case the Court had decided that a bequest for the purpose of building an Anglican Cathedral was not exempt from duty.
In the case Lever llors. versus Newton Bros., the Appeal Court allowed the appeal with co»ts oil the lower scale. Respondents were sonpinakcrs, and hid applied for registration of the trade mark "Hising Sun" in connection with the article. Appellants are also soapmakers of "Sunlight" soap, etc. They objected, but the registrar had allowed registration, and on appeal to the Supreme Court the Chief Justice affirmed that decision. The judgment of the Appeal Court reverses the hitler's decision, Sir. .lustier. Chapman stating iu his judgment that he concurred with his brother Judges after great hesitation.
