Per Press Association. Auckland, April 30. Judgment was given by Mr. Justice Cooper this afternoon in the appeal case of Jlrown v. Ainbury, ill which the point involved was the interpretation of tlie regulations under the Dairy Industry Act, 181)8. Appellant is a dairy inspector, and respondent a dairyman, who was charged with a breach of the regulations by failing to cleanse, within the period of four hours after use, milk cans used in or about his dairy. 'The case had been dismissed by the magistrate on the ground that the facts did not show that I Ainbury was the responsible party. His

llonor remarked that, as respondent was in possession of I-lie cans from 0.30 in the evening until nine o'clock next morning, the regulation would lie a dead letter if he was not tlie person to be held responsible for tile cleansing of the cans, lie allowed the appeal with £7 7s costs, and made an order referring the ease back to the magistrate, with a direction that a breach of the regulation had been committed. As conviction carried with it cancellation of respondent's license, and respondent had acted honestly in contesting the regulation, he suggested that a fresh license should be granted to him, or the information withdrawn.
