In connection with the proceedings taken against a Thames publican for exposing liquor for sale, a decision of considerable importance was given by, Magistrate Bu»h. As the details constitute a- new set of facts, the Crown Prosecutor conducted the case. Tha. evidence disclosed the fact that several boardes were at the slide of tho hotel bat; on Sunday ovening, being seryod w;ith drinks by the licensee's wife. Three other men, not boarders, entered the hotel by a back door unknown, so tho landlord said, to him. One of the. men said he had business with one of (he boarders, and the two other men followed him in. None of the non-lodgers had a drink or asked for any, but one passed the bar slide and conversed with one of the lodgers. The licensee's wife behind the bar said she did not know the man was other than the lodgers present. The decision of Mr Justice Richmond also had held that while, a licensee was committing a legal act (serving! drink to lodgers), he could not summit an illegal act by exposing liquor at th* same time. The magistrate held that the amendment of 1904 threw a still greater onus on the lt« censee and convicted the defendant.
