Mr/Harper, f or the appellant, contended that tho regulations on tho Christchurch course are invalid because they do not prohibit betting generally, but only by a particular class. They were solely intended to protect the t'otallsator, and not to maintain good order. He also argued that the Legislature never contemplated that a broach of regulations should turn an offender into a criminal, and expose him to Imprisonment. Mr Stringer, for <}ie other side, contended that it was not necessary that what was prohibited »hould necessarily bo a nuisance, but that If carried to a certain point it might become a nuisance. The appellant by persistence In disrvgnrding warnings had become a wilful trespasser, and as such was liable under the Polico Offences Act to imprisonment. Tho court reserved its decision.
