Appeal Court.
(Per Tress Association), WELLINGTON, April 21. The Appeal Court gave judgment in the case, lliddiford v. I.he Borough of Hult. which is of interest as bearing on the vexed questioning of street widening. A majority of tho Court held that the owner of the lam! in subdividing it for sale was not bound to dedicate laird for widening streets under the Public Works Act, where the allotments front only to an existing street, and the owner is not laying out new streets. In this case tho owner had dedicated the land and claimed compensation from tho 'burough, but the Court held that he was not entitled to compensation. The Chief .Justice dissented, considering the owner was bound to dedicate, . and was entitled to compensation.
In the case King v. Hone Ma;ak-a Makomako the Appeal Court held that, the evidence on each charge was properly admissible in the others, and therefore deems .Judge J)enniston right in ordering all three counts lo be tried together. The conviction was aMirined.
The Court was unanimous in allowing the appeal in Paterson v. Fleming, an action for damages through respondent being gored by cattle at Tauranga. The Judges differed in their reasons for arriving at a conclusion, but were unanimous in concurring that -apjwllant was not responsible and that the judgment of the Supreme Court must be reversed so far as he was concerned.
