PIAKO COUNT? COUNCIL V. WAIKATO CCUNTT COUNCIL.—APPEAL. In this action, Mr Dyer appeared for the appellants, the Piako County Council, andMrTheo. Cooper for the respondents. It was a motion on appeal from the decision of the Stipendiary Magistrate., Although the amount involved in the action was small, the question at issue was a somewhat important one. It was whether a County Council, having under the Sale of Alcoholic Liquors Control Act, 1894', control and administration of all licensing matters within their jurisdiction can recover from the contributing bodies for clerical assistance. The action was brought by the Waikato County Council to recover a. sum of £ 2.2 s for clerical assistance, and it was heard at Hamiltou before Captain Jackson; S.M., who disallowed a claim for Interest hut gave judgment for service and labour, £1 5s 9d, and eosts 19s 6d. The question for the Court was whether this decision was right in point of law. It arose out of the construction of the Act and the facts were simple. After hearing argument of council His Honor dismissed the appeal with costs £7 7s.
