His Worship asked Clarke what, su^ he proposed to offer in satisfaction of the maintenance order. In reply Clarke said : lie hardly , knew how to answer that question. He wanted his Worship to make an award on the lowest possible scale, so as to enable his son to he released from prison, and he would do his utmost to pay it. His Worship here read the clause of the Act bearing on the question, which states that the amount fixed iv lieu of weekly payments must not be Jess than L2O or more than LI 50. Clarke : I offer to pay L2O down, I believe 1 can get it from a friend, if your i Honor will fix the amount at that. My son has no means beyond what he could earn when released from prison, and I therefore hope Your Worship will fix the sum at L2O. His Worship : The coats and arrcais up to last Court day amount to L 34 12s. Clarke : I will pay that if your Honor will allow me six or eight months time to do so. I could not do moro now than raise the L2O. His Worship asked Mackie what he thought of the proposed agreement, Mackie : Mr Clarke told me himself when he failed that he had an indcpendant income. He has also told me his boy had means of his own. Clarke : I wish your Honor would put Mr Mackie in the box and see if he would say that. Mackie : I know the Clarkes could just as easily pay the 10s a week as a 6d, if the will was there. There are a lot of cattle all bearing Clarkes son's brand. I think the amount Mr Clarke offers a very paltry sum, and do not see why I should be saddled with bringing up the child j still I am willing to leave the matter in your Worship's hands. Order made fixing the total sum to be paid at L 56 12s ; L2O at once, and the balance on or before Nov. J4th next.
