Police v. Russell : In this case Alexander "Russell was charge 1 by Sergeant Emor^on (T ) with being drunk and disorderly in "Wlii taker street, Te Arolia, on Saturday afternoon last, and (2.) with making- use of olvcene language in a public place, to whit "Whitnker street, Te Aroha, on the afternoon of same day. Accused pleaded guilty to both charges. Sergeant Emerson stated the circumstances of il c case in each instance, which were briefly as follows : That about three o'clock on Saturday afternoon a complaint was made to him that accused was very drunk and making use of most filthy language. He immediately went up and warned accused to at once go home, but instead of that he lay down on the footpath after going a short distance towards his home. He then arrested him, but he refused to walk and had to be conveyel in a part to the lockup. The language he made use of in his hcaiing was filthy in the extreme, A witness, J, W. Jl. Grtiildino:, bookkeereeper (o Mr John Wood, butcher, Te Aroha, was examined on oath, and stated accused abused him in a most wanton manner, using very foul language and sat down on the door step of MiWoods' shop, causing obstruction to business and great annoyance. His conduct was very bad. A number of previous convictions were on record against accused, and about two years ago he served a term of three months imprisonment with hard labour for obscene language, The Bench fined accused lOs, and 2s court costs, or in default twenty-four

hours imprisonment for the first offrfiuc ; the costof conveying liim to fc'io lock-up, 23 Gd, to be deducted from any money found in his possession ; and sentenced him to three months imprisonment with hard Jubour in Auckland public prison for the second offence.
