RESIDENT MAGISTRATE'S COURT. (Before H. A. Stratford, Esq., R.M.,) Tuesday, January 18, 1887. CIVIL CASES.
E. H. Littlejohn v. Mrs Kitcheson : Claim £2 14s 6d for wages. Summons not served. Adjourned till dth February by the Court. Moses Holchin v. Joseph Eoberts : Claim £3 lls Id for goods. Judgment summons. Defendant swore that although receiving 9s a day for the past six weeks, he had previously been working as a tributer at Thames for five months unsuccessfully ; was a married man with three young children to support, and had no means whereby to pay off this debt since judgment had been obtained. Order refused ; plaintiff to pay 13s costs. Robt. Nelson v. Geo. Gapes : Claim £1 16s for grazing horses. Defendant admitted indebtedness to the extent of 14s. Plaintiff, in his sworn evidence, stated that the account was for nine weeks' grazing of two horses from October 26th to December 28th at 2s each per week, and that when defendant brought the horses on October 26th he informed him what the charge would be, that he had furnished an account to defendant on or about December 7th for the amount then due at 2s per horse per week, which acoonnt he had promised to pay, and that it was not till a week afterwards he disputed the account, and offered to pay at , the rate of Is per horse per week.
Defendant, on being examined, swore that the agreement made at the time was Is each horse per week although plaintiff at first asked 2s, and he had a witness, Donald Munro, in Court, who, on being sworn and examined, substantiated his (defendant's) evidence. Judgment for 14s, without costs.
