FATHER’S DUTY TOWARD DAUGHTER
N.S.W. COURT JUDGMENT
Reed. 9.10 a.m. SYDNEY, Today. Emelie Polini, the well-known actress, whose death occurred in America some time ago, left a will which ,ame before the New South Wales courts for interpretation. The testatrix excluded her husband. who is an Australian, from the will and left all her money to her four-yqar-old daughter, Patricia, on condition that she was taken from her father and reared by her uncle and aunt in England; but should the father decline to agree to this arrangement, then the child’s inheritance should be substantially reduced. The court held that the testatrix's condition was opposed to public policy. and was likely to deter the father from performing his parental duty, which was sacred, just as were his rights, therefore the gift to Patricia was. absolute tinder this condition. The child will inherit the whole estate when she is 24 years old, totalling about £20,000.
