OBJECTION TO SUBDIVISION CONDITIONS APPEAL BOARD APPOINTED The Government has appointed a. Board of Appeal to hear objections by Mr. ID. It. C. Mowbray against the Takapuna Borough Council’s conditions in connection with the subdivision of land fringing Lake Pupuke. The date of hearing has not yet been fixed. The personnel of the board is:—Mr. F. K. Hunt, S.M., chairman; Mr. .N. A. Duthie. accountant, appellant’s nominee, and Mr. A. Greville Walker, civil engineer, the council’s representative. The section of the property involved in the dispute is just over an acre. It fronts on Kitchener Road, Takapuna, and abuts in to Lake Pupuke The appellant’s plan of the subdivision shows the section to be bounded by the lake on one side, and has a 14ft. right-of-way to Kitchener Road. The council’s proposals are to provide a 33ft. strip of reserve on the lakeside, and to form a 66ft. roadway between the reserve and appellant’s property. It is stated that Mr. Mowbray would be able to divide the large section if thought desirable, but appellant does not agree to the stipulations. The appeal is under section 335 of the Municipal Corporations Act, 1920. The clause provides that the council may, before approving any plan of subdivision, require the owner to make further provision for the construction of streets or for making reserves, or may require such other alterations of the plan as it thinks proper. The section provides that any person aggrieved with the council’s decision has the right of appeal to a board appointed by the GovernorGeneral and consisting of a magistrate and two other persons nominated by the appellant and the council respectively.
