QUESTION OF IDENTITY
MAORI FACES GRAVE CHARGE GUILT DENIED / The main question at issue in* the trial of Mu Matatahi, on charges of attempted rape, indecent assault and common assault, is that of identification. It was alleged that an assault took place near Mercer on January 18, the complainant being a married woman. Mr. Justice Blair presided, Mr. Hubble prosecuted and Mr. Rose appeared for the accused. There was no doubt that an assault did take place, said Mr. Hubble, and it was of sucli a nature that any of the charges would cover it. That same night complainant identified the accused while he was hiding behind a bush.
In a statement the accused denied that.he committed the assault and that he was hiding behind the bush. Evidence of the alleged assault was given by the complainant. A neighbour to whom she ran after the assault gave evidence as to torn clothing and bruises on complainant’s body. — ,
