LAND DEAL DISPUTE
CLAIM FOR INSTALMENT
FULL AMOUNT AWARDED Judgment for the amount claimed was given in the Magistrate’s Court this morning by Mr. E. C. Cutten, S.M., in a case in which C. S. and F. H. Renahaw claimed £145 from Mrs. F. A. A. Spinks. The money was an instalment on the purchase of a number of sections Bear Northcote, for £1,550. The defendant said that the plaintiff’s agents induced her to purchase the properties by making two misrepresentations, and further, that she was subjected to undue influence. She alleged that the agents represented to her that the Waitemata Harbour bridge would be commenced within 12 months, and the sections would thereby ba greatly increased in value. A great deal of contradictory evidence had been submitted, said the magistrate. The defendant had quite clearly agreed to make the payment ■ued for, and in making the defence •he had put forward, the burden of proof was upon her. She had not discharged that burden.
