A TRIPLE ACTION

SEQUEL TO MOTOR SMASH ALLEGATIONS OF NEGLIGENCE Three actions iri one, all hinging oin a motor-car collision in Great South Road on March 8, came before Mr. Justice Stringer in the Supreme Court this morning. Godfrey Ohms, builder and contractor (Mr. Goldstine), proceeded against Walter Henry Pankhurst, taxidriver (Mr. Berkerleg), claiming a total of £4OB 4s damages resulting from the collision. Pankhurst, in the next action, claimed from Ohms a total of £302 11s damages for the same cause. The third action was brought by Prank O’Donnell and his wife, Lilia O’Donnell (Mr. G. P. Finlay), who claimed from both Pankhurst and Ohms a total of £BOO damages for injuries received as the result of the collision, when Mrs. O’Donnell was a passenger in Ohms’s car. On the day in question Mrs. O’Donnell was proceeding to Mangere in company with her mother and child, in the car driven by Ohms.

Near the corner of Rockfield Road and Great South Road, a collision occurred with a car driven by Pankhurst, and proceeding toward Auckland. Both cars were wrecked, and Mrs. O’Donnell suffered concussion of the brain. Her husband claimed £22 expenses, and the remainder of the claim was brought by Mrs. O’Donnell as special and general damages. In the case of Pankhurst he alleged negligence on the part of Ohms, and the latter brought the same allegation against Pa.nkhurst. Lengthy evidence is being heard.
