The deficiency of a widely advertised and cheaj> baking powder was the subject of a prosecution of the Home a" Colonial Stores, Ltd., before Mr F. \ . Frazer, S.M., this morning on a charge oi having sold baking powdei that, on being healed with water yielded only 1.01 per cent, oi carboi dioxide instead of ten per cent, re quired by the Pure Food and Drug; Act. This particular chemical com pound gi\ cs baking powder its cine property of “rising,” or aerating tin confections in which it is used
His Worship said that, though ho believed defendants had acted hou-i estly and in good faith, they mightj have, iu the absence of a written; guarantee, taken the precaution oij having a sample of the powder analy-j sed. Without this they could not es-j tahlish a complete defence. The arti-j tie was “cheap and nasty” in the sense that it was a penny a tin cheaper than, the usual price, while at the same time it was only half the strength. Still, the analysis showed that no alum sulphate or other unwholesome chemical was added to it. 1 here was no question of defendants will ally doing a wrong, consequently he would not order any advertisement of the conviction, and would not inflict a heavy monetary penlty. Defendants would be lined £‘2 and costs.
