(Before H. M'CtrtLOCH, Esq., R.M) * FsmAT, 26th Apbi_. Thomson v. Davidson. — Claim for £50 for use and occupation of certain land at Oteramika for one year under agreement. Mr Macdonald for plaintiff. Defendant did not appear.' Plaintiff's counsel stated the conditions of agreement under which the land in question had been held by defendant, and called plaintiff's agent in town, Mr T. Brodrick, who deposed that defendant had admitted liability. Judgment for plaintiff for amount claimed, with costs, £3 7s, the costs of service being left over until the amount should be ascertained. M'lntyre v. Cuff. — This was a claim for £3 14s, being balance of account for horse hire and livery. Mr Macdonald for plaintiff ; Mr Wade for defendant. The evidence herein was very conflicting upon the question whether a sum of £3 had been paid on account of a certain order given by defendant, and further, defendant alleged that in a subsequent transaction relative to poultry, between himself and the plaintiff, 10s had been allowed by defendant in full settlement of outstanding claims. Tho Bench held that payment had not been proved.. Judgment for plaintiff for £3 8s and costs, 9s, to be paid by instalments of 15s per month. Mr Wade applied for leave to make application for rehearing in the case of Thomson v. Davidson, defendant having just arrived. Leave was given to state grounds of application at three o'clock, to which time the Court adjourned. - On the Court again sitting, a rehearing was granted, to take place on Monday, 13th May, provided the defendant in the meantime paid into Court tho sum acknowledged by him to be due, viz., £25, with the costs already adjudged. Monday, 29th Apbil. Hateh v. Monckton.— This was a claim for goods supplied. Mr Wade for the defendant applied for an adjournment on account of the shortness of the time which had been allowed to the defendant to examine the accounts. Adjourned to Monday, 13th May.
