DISTRICT COURT.
TIMAIUJ— I THIS DAY. [Before His Honor Judge Ward.] IN BANKRUPTCY. Be E. Jenkins, D. McKay, and F. Fraser bankrupts. This case was heard at the last sitting of the Court, when His Honor reserved judgment. As will be remembered, Mr White made an application that Ituthcrford be compelled to deliver over certain moneys in his possession, belonging to the' estate of the above named debtors. Mr Tosswill opposed the application. Home further argument having been adduced on both sides, his Honor made an order for the restitution of the money realised by the sale of the stock of the bankrupts, less expenses connected with such sale, and further ordered that the residue of unsold property be handed over to the estate forthwith. Be J. High, a debtor. Application for an order of discharge. Application adjourned until next sitting of the Court. Be Frank Poll, a debtor ; application for an order of discharge. Mr Tosswill appeared on behalf of applicant; Mr White appeared to oppose on behalf of the trustee. This case was heard at some length, the applicant being examined by both sides. Finally Mr White asked that the application be dismissed, and that an order be granted to him authorising the prosecution of the debtor for not delivering up certain property belonging to him at the time of Ids filing bis declaration of insolvency. He asked that the prosecution be made under sub-sections 1,2, 4, and G of “The Fraudulent Debtors Act.”
The application for order of discharge was dismissed, and Air AVhite’s application re prosecution for fraudulent insolvency was granted. The Court then adjourned until Feb. 20.
