TIMAEU —THIS DAY. [Before 11. Boethain, Esq., E.M.] Judgment by default -was given in the following eases: —Hamcrsley v. T. B. Chadwick, £33 11s 2d; Cornish v. Packman, £8 12s 9d ; Shepherd (trustee) v. Goddard, £1 3s 7d ; Same v. George, £t 7s ( Jd ; McLean and Stewart v. John Hall, £3B 18s 2d. D. Ogilire v. D. Fallard—Claim. £ll 18s lOd, on a promissory note. Defendant admitted £9, but objected to the difference, namely, interest at the rate of 8 per cent. Order for amount, and costs. John Stack y. Pat O’Connor —Claim, £2 Gs, balance for work and labor. Mr Hamcrsley for plaintiff; and Mr Jameson for defendant. Plaintiff and defendant had taken a job, cutting a drain, as partners, and the amount was for work and labor, and three longhandled shovels and an American axe, which plaintiff alleged had been given away by O’Connor. Mr Jameson applied for a nonsuit on the ground that the parties were partners. A nonsuit was granted without costs. Geo. Hurley v. Edward Stcnnings. Judgment summons. Plaintiff stated that since the order against Stcnnings was made on Sept. 17, he (Stcnnings) had been at work, and Stcnnings acknowledged having earned £2 10s in the interval. The plaintiff was informed that before going to the expense of taking out a judgment summons he should be in a position to prove that the defendant, over and above the means of living, had had an opportunity of complying with the original order. The summons was dismissed.. The Court then adjourned.
