LICENSING COURT.

THIS DAY. (Before Messrs Beetham, Belflcld ami Elworthy. Commissioners.) Alexander Sutherland Smith applied for a license to sell spirituous liquors iu connection with “ shades and luncheon rooms ” in Church street. Mr White appeared for the applicant and presented a memorial signed by over 100 residents representing that such an establishment was necessary for the public convenience: Mr Hamcrslcy on behalf of John Jackson, a householder opposed the license, which, was also opposed by the police. It was stated that the license was of a general character under the Canterbury ordinance tire fee being £75. Mr White urged that Mr Jackson’s objection could not be entertained as the requsite notice required by sub-section 8, of clause 28, of the Act of 1871, Had not been given. Mr Hamerslcy replied, contending that the Bench could entertain an objection at any time. He submitted that there were already three hotels—the Ship, Clarendon, and Old Bank Tavern—iu the immediate vicinity of the house for which a license was now asked, and that no complaint had been made by the public about the want of hotel acconv modation. Mr White relied on the prayer of the memorial, and commented on the circumstance that the objection was supported by the solicitor of the Licensed Victuallers Association, prob. ably with the view of maintaining a monopoly. He also pointed out that the applicant had gone to large expense in connection with the steps he had taken, iu anticipation of his license being granted. Mr Beotham, after consultation, stated that the Bench was of opinion that the house was not required, and the application was refused. Transfers of licenses were granted as follows :—Albion Hotel, O’Brien to Hoare; Bailway Hotel, Manning to Ackerman , Melville Hotel, Mullens to Bichmoud; Three Creeks Hotel, Burke’s Pass, Stock to Bradley.
