RIVAL COMPANIES CONTEND FOR WAIRAKEI-ROTORUA , ROUTE A sitting of the Transport Appeal Board Was held in the Rotorua Courthouse at 10 a.m. on Saturday 'morning to hear an appeal hy the "K" Motor Service Ltd., against the is^ue to the Rotorua Motor Transport Co., of a license for the Rotorua-Waira-kei run, Mr. Justice Frazer presided, with him Messrs Jordan and Alderton. ' - ' Mr. M. H. Hampson appeared for the appellants and Mr. E. Roe for the defendants. Comme'nting on the appeal the Transport Department said the trouble appeared to have Originated owing to misunderstanding hy the operators of the two seryices and in£the respondept company, who Were apparently entitled to an automatic license under Section 28, omitting1 to make the second applieation hefore the "appointed day." The defendant company said the p'lain faets of the case were that the "K" Motor Service, Ltd., applied for an altered time-tahle for the" run in question to suit their own purpose entirely. They now. found, that they 'had made a mistake and were endeavouring to place the blame for their ihistake, with the defendant company. The "IC" Company had got what they asked for, and the defendant' cOmpany was not concerned in any difficfilty which had arisen. Gounsel's addfess and eviderice hy Mr. P. A. Kusah# occupied th'e morning sitting and the ' court then adjourned until Monday.
