WANGANUI DISTRICT COURT.
A Marton Case. At Wanganui .District Court yesterday, before Judge Haseldeu, A. T. L. Mather brought au under the Coutractors and 'Workers Lien Act against E. Newman, A. Brown and. J. G. Campbell. Mr Mackay appeared for the plaintiffs, Mr Cohen for defendant Newman, Mr Milos, Marion, for defendant Brown, and Mr Cunningham for defendant Campbell. Mr Newman had let a contract to Mr Brown to build a house at Marion: Mr Brown had sublet the painting to Mr •Campbell who employed plaintiffs to uo the work. The plaintiffs claimed tlmt Campbell owed them. £10!) 18s fed wages, and asked that, the money payable by Newman to Brown should bo charged with payment of these wages. The] Defendant _ Newman brought the "amount claimed into Court to abide the recult. The defendant Brown pleaded in his statement of defence that he had already paid Campbell the money due to him, and both he and tho| defendant Campbell denied that the amounts claimed as wages were owing to the plaintiffs. After hearing evidence judgment was given against the defendant Campbell for the full amount claimed, with costs, and the defendant Brown was ordered to pay plaintiff'23 per cent of the moneys ho had paid Campbell, as it was his duty to have retained that amount for ill days. The question whether the remainder of the wages could bo recovered out of the moneys due by Newamff to Brown was reserved.
