Application was made to the Advances Department for the loar.s. and in due course a reply was received regretting, on account r.f the scarcity of funds, tbe inability of the Board to giant the leans asked for. Hie Council were not prepared to accept tha redy as final and wrote to the effect that the money would rot benquired for 12 minths, and that a refusal meant that all tiouMe and expense incurred would have to be gone over a second time.
At Wednesday i ight'a meeting of the Borough Council the following reply from the Superintendent of tha Advances Office wa» read:"I have to call jour attention to No. 6 of the regulations, wherein express rotice is given of the fact that the provisional approval shall not constitute any agreement between the Board and 1 cal authority, n:jr shall affect in ary manner the right of the Board to refuse to grant the loan. As 1 have pointed out in my letter of the 3rd ult., it is with extreme reluctance that these loans have been declined by the Board, but the heavy drains on the Department's funds compelled the Board to refuse all applications. as you state, however, that the greater part of the loan money will not be requited for at least another year, I am prepared to submit your application to the Board when fresh financial arrangements have been made. I cannot, of course, give you any guarantee as to the result, but the Board would doubtless, subj. ct to the provisinr.s of tections 7 and ? of the Amendment Act, 1912, giva preference to applications such as your?." AN OLD ACCOUNT.
The Wanganui Spiral Pipe Company wrote "with further rererence again to the old matter of interest, we would point out that there is no legal disability to your Council paying this undertaking entered into by their predecessors, as the Frankton Town Board are in exactly the same position as the fukekohe Board, They were unable to pay uur progress payments on due date, but they on their part were quite willing to pay us interest on the overdue amounts. The position taken up -by your Board is a most unfair one. If they had teen in a position to have paid as our progress paymenta due, then they would have had interest to pay to the persons from whom the loan was obtained. By now repudiating the undertaking to us your Council are practically in the position of having money which they are rot honourably nor justly entitled to That i?, they have saved interest to an amount of some £75 at the expense and loss of this Company. —Referred to Borough solicitors for an opinion as to the legal position of the Council. BUILDING PERMITS.
