WARDEN’S COURT,
Havelock. (Before John Allen, Esq., R.M.) [Wednesday, April 30.] James Flanagan v. James Hayes, legal manager of the Golden Bar Gold Mining Company. Claim £54 7s 6d. Mr Staite appeared for plaintiff, and Mr M‘Nab for defendant. This was a case in which the plaintiff claimed the balance due on a contract for driving a tunnel into the reef, for which he had not been paid the full amount for the work done. The plea for the defence was that the contract had not been completed, nor had the work been done according to specification, and that the company had suffered considerable loss in consequence —equal in amount to the sum due on the contract. That the plaintiff had asked to be relieved of the contract to which the company had consented. t The Warden nonsuited the plaintiff without costs. APPLICATION. E. H. Beere for tunnel.—Granted. Most of the civil cases were settled out of court, but judgment for amount and costs was given in several cases brought by the receiver of gold revenue.
