(Before Captain Porter and A. Graham, Esq., J.P.’s.) THIS DAY. S. M. Wilson v. F. Thomson. Judgment Summons, £2 17s. Mr. Ward for the creditor. Adjourned after taking evidence to the 16th October. E. Devery v. A. Gillice. Judgment summons, £5 9s. Mr. Finn for plaintiff. Ordered to pay the amount by the sth of October, in default five days imprisonment. Costs, £2 Is. A. W. Croft v. G. Burgess. Claim £l7 ss. M. Ward for plaintiff, Mr. Finn for defendant. Mr. Ward asked if opposing Counsel would admit Mr. Croft’s appointment as Creditor’s Trustee of the property of C. D. Berry. Mr. Finn agreed to do so in this case, but would object to do so in any other case. Mr. Croft gave evidence to having recovered other amounts in the same estate By Mr. Finn—Did not keep copies of letters sent to defendant.

W. H. Clayton—Clerk in Berry’s employ. Partly kept the books and knew handwriting of (he person who did the balance. Had rendered the account.

Mr. Finn submitted that the person summoned was altogether a different person from the George Burgess referred to in' Berry’s books.

George Burgess—Never borrowed a shilling from Berry. He took a load to the South Pacific Oil Spring by direction of Berry, who was then manager. He got £l5 on account from Berry for work done for the Oil Company, leaving a balance due. Berry never carted any goods for him. Never had but one dealing for timber with Berry, and had been insolvent since. Knew two or three Burgesses. By Mr. Ward—Had never spoken to Mr. Croft to his knowledge. Defendant had a number of questions put by the Court. After voluminous arguments pro. and con. the Bench decided to adjourn the case until Friday next, for the production of further evidence. Same v. E. C. Bolton. Mr. Ward for plaintiff, Mr. Finn for defendant. Claim £2 6f. 6d, balance of account in Berry’s estate. Mr. Finn claimed a non-suit on the ground that the defendant was not properly sued. 'Left Sitting.]
