MAGISTRATE'S COURT
POSSESSION OF ROOMS The plaintiff was the Canadian wife of a Dunedin serviceman, who had purchased a house to provide a home for her husband and two young children, said Mr J. G.. Warrington in the Magistrate’s Court yesterday, when appearing for Helen Vera Roberts, who sought possession of a property at 63 Passmore crescent from the present tenant, William Edwin Shaw (Mr J. C. Robertson). Mr Warrington said that the plaintiff, her husband and children were at present living in one room at the home of the husband’s parents. The family had been asked to find somewhere else to live. The defendant had been offered alternative accommodation. Alan Dudley Roberts, husband of the plaintiff, said that in the event of his wife getting possession, his State house priority would be transferred to the defendant. Counsel for the defendant said that in the event of a State house not becoming available within one month, the defendant would be willing to give the plaintiff a room in the house he was occupying. The magistrate, Mr J. D. Willis, made an order for the possession of two rooms and the use of conveniences on or before December 16. In the event of a disagreement as to the room, the matter would be referred to the court Order for Possession The Otago Brush Company, Ltd, (Mr J, P. Ward) proceeded against Mrs Nancy C. Madden for the possession of premises at 10 Windsor terrace, Dunedin. The plaintiff also asked for £3O (mesne profits or damages and costs.—An order was made for possession on or before December 2 Judgment was entered for £3O mesne profits, and costs were also allowed. Order Refused Sarah Rosetta Stewart (Mr R. G. Calvert) sought from Violet Florence Galvin (Mr W. H. Reid) possession of a dwelling at 94 Stafford street.—Mr Calvert said that the issues between the parties were those of suitable alternative accommodation and the relative hardship of the parties.—After hearing submissions, the magistrate declined to make an order. Undefended Cases Judgment by default was given for the plaintiffs in the following cases:—Commissioner of Taxes v. G. B Phillips, £2B 14s lOd, with costs (£1 11s), taxes unpaid; Nimmo and Blair, Ltd., v, C. Johnstone, £lO 15s. with costs (£2 15s). goods supnlied: Nimmo and Blair. Ltd., v. W. Williams, £3, with costs (£1 5s 6d). goods supplied: Bernard Hill v. James V. Satherly, £5 10s with costs (£’ 10s 6d), balance owing for money lent; Stanton Bros., Ltd., v. L. Cameron (Matawai), £1 11s 3d, with costs (10s), goods supplied Judgment Summons William Henry Hamilton, jun., proceeded against J. A Henderson on a judgment summons. There was no appearance of the defendant, who was ordered to pay the amount of the judgment remaining (£2l 7s 6d), with costs (£1 lls 6d), in default 21 days’ imprisonment.
