MAGISTRATE'S COURT, TUAPEKA.
January 21, 1861, ■• (Before Mnjor Croker, J.P.)
C. Birss was charged, on the information of — Burgess, rovenuo officer, witli having illegally sold a quantity of spirits to the extent of about two gills. Defendant, who pleaded "not guilty," -was remanded to Dnnedin to take his trial on Monday the 27th January. It appears that the defendant in the above ease, hud heen previously summoned, but as the summons was informal, being dated 3rd Jan., 1961, ho had declined to attend, and that in consequence of his non-appearance Major Croker issued a warrant for his apprehension. He was accordingly apprehended on Monthly lnst, and on his appearing ) efore tho Major, bail was tendered on his behalf by "two most respectable persons but refused, the Major alleging that as he had thought fit to take advantage'°of a technicality, he " would make it a lesson to him." The defendant was then taken to the lock-up, and confined there until the next day.
