SUPREME COURT.
In Banco. [Before His Honor the Chief Justice.] ' In re the appeal of the late Sir David Monro against a conviction under the ftMarlborough Scab Act. Mr Acton Adams, for the respondent, had put the case down for hearing. Mr ftFell, for the Executors, was not prepared to admit any liability or responsibility on their part. Mr Adams then applied for an order under the " Appeals from Justices Act," to the eifect that the appeal had not been duly prosecuted. His Honor granted this, tbe effect, being that on filing the order in the Court where the conviction took place, execution may be issued for the amount of the penalty.
