MAGISTRATES' COURT.

[Before R. Ponocic and C. Hunter Brow. Esqs., J.J.F.] John and Jamea Campbell were charged by Detective Ede with stealing four £5 notees, the property of ' Thomas JBayliss, of the Globe Hotel.

Mr Bunny appeared-vftoij the defence. Mrs Bayiiss stated that the prisoners bad been lodging at the Globe for two months. They occupied a bedroom on the same landing as my own. In tho top draw iv a chest of drawers she had £43 on Saturday, the 30th March. There were four £5 notes, eleven £1 notes, £5 in gold, £4 in silver' and two cheques. The £5 notes were at the' bottom, the oue3 on top of them, and the cheques at the top of the drawer. These were in front of the drawer, aud the gold and silver, the former iv a pile bo*, at the back, On Saturday I locked the drawer and gave the key to my mother. On Sunday morning I got the key from her and took out 1 6s: The chequfes and notes Were as t left them" on the previous day. I went up country on Sunday, and remained till the following Thursday. On'the Saturday morning the prisoner James Campbell came into my bedroom, where t was unwell at the time, and asked what he owed me. I asked my daughter to bring the drawer containing the money to me She did so, and Campbell was close enough to see its conteuts; James Campbell khew where 1 kept the key, but I don't know whether John did. Cross-examined: My husband is away in Wellington. I had two other lodgers besides them. When I returned from the country my mother took me upstairs aud showed me how the money was turned about. The enquiry was still proceeding when we went to press.
