MAGISTRATES' COURT.
[Before the Hon. T. Berwick, and J. R. Dodson, Esq , J. J.P.] Joseph Mallarao was charged with assaulting John Utrange on the 4th iust. Mr Pitt appeared for the complainant, and Mr Atkinsoa for the defendant. The assau't was alleged to have taken place on Akersten's patent slip. The evidence was very lengthy, and at times somewhat unintelligible, the witnesses being principally Italians. The defence was that complainant had made in suiting propositions to Mallamo's wife. Defendant was fined 10s and costs £2 15s, and received a warning against taking the law into his own hands. John Goodman was charged with using insulting language to Brian Hennesay (Professor Hennicke) for the purpose of annoyance and provocation, and it was asked that he might be bound over to keep the peace. Mr Buany appeared for tha complainant and Mr Pitt for the defendant. The complaint was that Goodman had been engaged to post certain bills, but failed to do so satisfactorily, whereupon the complainant had to do the work himself. Goodmau then met him, and called him "a rogue, a swindler, and a loafer." The case was dismissed, with costs £1 10s. Dee v. M'lvor.— Claim for £4 10s for clothes supplied* Mr Bunny appeared for the plaintiff, for whom judgment was given, with costs £1 12s. Protheroe v. Wett.— Action to recover 10s for goods supplied. A set off of £1 6a was lodged. Mr Atkinson appeared for the plaintiff, and Mr Pitt for the defendant. Plaintiff was nonsuited, no costs being allowed. James v. Proudfoot.— Claim for £6 12s 6d. Judgment for plaintiff for £5 2s 6d, to be paid within a month. D. Burns v. Kellow.— Action to recover £7 for rent. Judgment for plaintiff for amount claimed and costs, to be paid in ■weekly instalments of 12s.
