S.M. COURT.

MONTHLY SITTING. The monthly sitting of the local S.M. Court was held this morning before Mr. J. L. Stout, S.M. BY-LAW CASES. Charged with allowing stock to wander on borough roads by the inspector (Mr. W. Neville) the following were fined 5/- with costs 10/-: H. Hussey, A. Fowler, Fred Robinson, R. Byne, and A. M. Wright. 'For tethering a horse in Thynnc Street H. Hutchins was lined 5/with costs 10/-. DRIVING WITHOUT A LICENSE. C. de Bidder was charged by the inspector (Mr. W. Neville) with driving a car in Main Street without a license. The inspector stated that de Ridder was employed by a local plumber and was in the habit of driving his employer’s car about on (business. He had since obtained a license. A fine of 5/- with costs 10/- was imposed. FLAX REFUSE IN RIVER. The Acclimatisation Society (ill*. P. W. Wilson) proceeded against Messrs E. W. Sutton, C. King, and W. J- Ross for allowing flaxinfll refuse to flow into the Mana'watu River.

Mr. M. B. Bergin appeared for defendants and made a preliminary objection to the section under which the charge was laid. He said the charge was made under an Act gazetted in 1907 which made provision for the prohibition of dumping sawdust into streams. The regulation authorising the Fisheries Amendment Act had not yet been made. After some discussion it was decided to adjourn the eases until next court day. CIVIL CASJIS. Judgment was given for plaintiff in the following civil undefended ease: — (Commissioner of Taxes v. G. Gotty, 8/3, costs 16/-. JUDGMENT SUMMONSES. Robert Andrew was ordered to pay E. M. Wyllie £8 2s Od forthwith, in default eight days, warrant suspended as long as defendant pays 10/- per month. R. Andrew was ordered to pay A. E. Collins £1 14s Od forthwith, in default tln-ee days’ imprisonment, warrant suspended as long as defendant pays 10/- per month. F. T. Shaw was ordered to pay S. 11. Wrigley £9 4s 6d in default ten days’ imprisonment, warrant suspended as long as defendant pays 10/- per month. Hanata Tatana was ordered to pay the N.Z. Loan and Merehantile Agency Co., Ltd., £l9 5s 5d forthwith, in default 21 days’ imprisonment, warrant suspended as long as defendant pays £1 per month. J, Dwyer was ordered to pay the . C. M. Ross Co., Ltd., £1 9s Od forth- >' with, in default three days’ imprisonment.
