HEAVY TRAFFIC BY-LAWS.

MAXIMUM FINES IMPOSED.

A fortnight ago, several cases concerning breaches of the heavy traffic by-laws of the Manawatu County Council, which had been held in abeyance pending judgment in the Court of Appeal in the case of Wm'. Berry v. N. I. W. Brown and Company, were adjourned in order to give the defendants an opportunity to comply with the Appeal Court judgment that they must obtain a license. When the Magistrate’s Court sat at Feilding on Thursday, the defendants —A. Wilson, carrier, of Wanganui, N. I. W. Brown and Company, carriers, of Rongotea, A. W. Stevenson, carrier, of Foxton, and G. T. Woodroofe, trading as the Foxton Distributing Company, were called at the instigation of the Manawatu County Council to answer the charges. Mr L. A. Elliot, who appeared on behalf of the Council, stated that the defendants had made no effort to pay the license fee due for the right of engaging in heavy traffic during last winter and the Council had no option but to ask that the maximum penalty be inflicted. According to counsel, the action of the defendants was in the nature of an attempt to defraud the Council of its revenue. Mr. T. Pagan, who appeared on. behalf of the defendant A. Wilson, staled that he had advised his client. to pay the. fee, but be had refused to do so. The cases were called separately, and in dealing with the first, the Magistrate, Mr R. M. Watson, S.M., said that; the defendant had been given the opportunity to pay the fee, and had not done so. There was nothing else to do but to inflict the maximum penalty. Defendant would be fined £5, the costs bill amounting to £4 3s. Cases arising subsequently were then dealt with. A Smith, carrier, oj’ Wanganui, being fined the maximum and costs £1 Bs, Percy Ilavill, of Pfrliuerston North, was dealt with similarly on each of two charges, and Will. Doyle, also of Palmerston North, was lined £2 and costs £1 Bs.
