In. the case against James Wilson, town clerk of Devonport his Honour interrupted accused’s coun sel to say there was no. suggestion and no cause for believing the girl (who was charged with him and discharged) took any money. He would tell the jury that as the case stood, she had nothing to do with the theft. Wilson’s defence was a complete denial of the theft. The judge; in e> sunumng up, said to constitute theft, the accused must have the mind of a thief. The jury, after five minutes, returned a verdict of not guilty and accused was discharged.
