SUBSIDISING SHIPPING.
DRAFT CLAUSES OF PROPOSED LOCAT. BILL.
The following draft clauses for insertion in the Washing-Up Bill authorising the Foxton Harbour Board to subsidise the loss suffered by shipowners trading to the port of Foxton was submitted at to-dav’s meeting of the Foxton Harbour Board: —
(1). Notwithstanding anything to the contrary in “The Harbour Act, 1908” or any amendment or re-en-actment thereof for the time being in force or any other Act it shall be lawful for and the Foxton Harbour Board (hereinafter referred to as “the Board”) is hereby empowered to enter into a contract or contracts with any shipowner or shipowners tradin- to the port of Foxton whereby the Board agrees and undertakes to subsidise and bear part of the loss or damage occasioned to or suffered by any such shipowner or shipowners in navigating the Manawatu river from the mouth of the said river to the wharves of the Board at Foxton, provided: —(a) That such loss or damage is occasioned to or suffered by reason of tli'e s natural defect in and the unsuitability of the said river for navigation by the ship or vessel of such shipowner or shipowners mentioned in the said, contract. (b) That such loss is not occasioned by or cansed through, or in any manner attributable to faulty navigation, negligence or want of skill on the part of any such shipowner or shipowners or the officer, employee, servant, ngenf <>r workman of such shipowner or shipowners. (c) That the amonnt or share of the loss or damage to he paid and borne by the Board under any such contract as aforesaid shall in no case exceed £SO per centum of the total loss or damage sustained or suffered by any shipowner or shipowners as fixed by arbitration as hereinafter provided.
(2). It shall he lawful for the Board to pay any moneys which it. may l> f ‘ liable to pay under any such contract as aforesaid out of the ievenno of the Board and the Board ■dm'! Mid ia any one year pay moneys under any contract or contracts as aforesaid in excess of the net revenue of the Board for that year.
(3). All contracts entered into l,v the Board under the foregoing provisions shall contain a clause providing Dm! any dispute between the parties to the contract as to the amount of subsidy to he paid or share if the loss to he borne by the Board shall he referred lo the determination and award of two arbitrators and their umpire, pursnj.nf to and so to have all the incidents and coiiseqiieiic.es of all arbitration under “The Arbitration AH. 1908.”
