APPLICATION FOR RIGHT-OF-WAY.

* REFUSED BY COUNCIL. The proposal to open a new street from Hall Street to Jolmston Street (practically a continual ion, of Whyte Street), which was before the Council some years ago, and then fell through owing to the Council and the owner of the land (Mr F. S. Easton) failing lo agree as to the width of the culvert necessary over the Awahou drain in Johnston Street, was again before the Council last night, when Air R. Moore, representing Mr Easton, was in attendance and applied for the Council’s sanction to a private right-of-way from Hall Street to the properly sold by Mr Easton to the Foxton Racing Club, and on which the slahies and cottage had been creeled. Mr Moore said that some years ago the land between Hall and Jolmston Street bad been surveyed .and laid off in sections, and Mr Easton’s intention at that time was to put the .street through, hut owing to some dispute with the Council in reference to the width of the culvert, this proposal had not been gone on with. Later he sold three of the sections to the Foxton Racing Club, and it was now desired to have these sections transferred to (he Club, but this could not be done until there was a proper road frontage to the sections, or at least a right-of-way to them. Mr Easton now asked for the Council’s sanction for a right-of-way from Hall Street to these sections, and if (hi.-, was granted the necessary transfer from Mr Easton to the Racing Club could be made.

Cr. Coley said that at the time, the previous application was made the Council stipulated for a 24 ft. culvert, but Mr Easton would only agree to pur down an 18 ft.’ one. There was a matter of about £.1.0 involved. When the Racing Club bought the sections from Mr Easton he guaranteed to put the road through within five years. The Mayor said that- in connection with new streets local bodies had extreme powers. When Hillary Street, was put through the” Council stipulated that it should he formed and metalled fight up to the connections with the adjoining streets, and that ft culvert the full width of (lie street was put in, and this had been done. The Council would be very foolish if if granted a private right-of-way. What was wanted was a proper street. As far as the width of the culvert was concerned, he considered the Council had been more than fair in only asking for a 24 ft. one. It would hot be long after the street was opened that users of same would apply to have the culvert extended to the full width of the street, and the cost of same would have to he borne by the Council, Cr. Bryant said lie thought the Council should offer to put in the balance of the culvert over the 24 ft. to Ihe full width of the street if Mr Easton would put in the 24 ft. and lay off, form and metal the new street in accordance with the conditions previously laid down. After some further discussion it was decided on the motion of tho Mayor, seconded by Cr. Coley, that permission cannot he granted for a right-of-way along the proposed site of Whyte Street, to the Racing Club property, but that the Council would be willing to lay pipes along the remaining 42 ft. of. roadway over and above the 24 ft. previously stipulated to be laid by Mr Easton, subject to Mr Easton complying with the conditions laid down by the Council re formation and metalling of. street.
