A LOCAL MILKMAN CHARGED.

CONVICTED AND FINED £2O

At the Magistrate’s Court yesterday, before Mr J. W. Poynton, S.M., George Edward Davis was charged, on the information of the police, with, on September 16th, 19x4, (1) did sell a food, to wit containing a substance, the addition of which is prohibited by regulations made under "The Sales of Foods and Drugs Act, 1909 and (2) with selling milk the percentage of milk solids other than milk fat of which is below the minimum allowed by the regulations under the beforementioned Act.

The analysis showed that the sample taken contained 20.9 per cent, of added water, and that the solids other than iat were 7.12 per cent., being 1.38 per cent, below that prescribed by the regulations under the Act.

Sub-Inspector Marsack said he had been advised that defendant intended pleading guilty, and uuder the circumstances, and in order to save him the cost of witness’ expenses, the prosecution had not subpoeued Mr M. O’Brien, who obtained the sample.

Mr Moore said defendant had instructed him to plead guilty. After the Sub Inspector had given details of the analysis, the Magistrate asked Mr Moore if he desired to make any statement on behalf of defendant.

Mr Moore said defendant simply asked him to plead guilty on his behalf, aud be did not desire to make auy statement. The Magistrate said be had already expressed his opinion iu cases of this description. The adulteration of milk was a fraud on the public aud a danger to the health of children. Defendant would be convicted aud fined with costs £1 4s 6d ou the first charge, ami on the second charge convicted and discharged.

Mr Moore asked if time would be allowed iu which to pay the fine.

The Magistrate allowed three mouths, sayiug it would keep him in miud of his .transgression.
