A LICENSING CONVICTION.

Wellington, August 17.

On the charge brought by the police against John Shelley, licensee of the Foresters’ Arms Hotel, of permitting drunkenness on his premises on July 13, judgment was delivered by Mr W. G. Riddell, S.M., this morning. The information was laid under section 181 of the Licensing Act, which enacts that if any innkeeper permits drunkenness on his premises he shall be liable to a fine not exceeding ,£io for the first offence.

Mr Riddell cited a judgment of Mr Justice Williams, who stated that if it is the duty of a licensee or his agent to put a drunken man off the premises, merely telling him to leave is not a performance of that duty. “I think,” remarked Mr Riddell, “that is exactly the position.” Defendant was accordingly convicted and fined with costs seven shillings.
