CLAIM FOR COMPENSATION.

Solicitor’s Opinion.

At last night’s Borough Council meeting, the opinion of Mr J. P. Innes, solicitor, was read in re a claim for compensation from Mr Reeve through falling through a bridge over Awahou drain. Mr Innes pointed out that the immediate cause of injury Jwas the act of another person in removing decking and as this person was not acting under instructions or authority, the Council cannot be responsible for the act of a stranger. In any case the Council is not liable for permitting a bridge or road to get into a state of nonrepair. The Council also received a letter in reply, from the Department of Lands, in reference to the road where the accident happened. The letter stated that a public road, one chain wide, is shown on all the plans between sections 554 and 556, Foxton, connecting with Johnston Street, it is also shown in the original Crown Grant. No closing of this short road is recorded. Mr Reeves’ solicitor has been informed that as the Council is not liable, it cannot pay compensation claimed.
