WARDEN’S COURT.

Friday, January 8. [Before J. Giles, Esq., Warden.] APPLICATIONS. The application of Patrick O’Rourke for a residence area of eleven perches fronting M'Gowan’s old tramway, came up again for hearing. The ground applied for was partly in the occupation of Rosa Cunninghan, who, applicant stated, had more land than he was entitled to hold, according to law; and applicant prayed that the certificate thereof be cancelled, or varied, and lube declared first applicant for portion of the land so held.—Complainant was authorised to measure off defendant to o 5 feet from his front south-east peg; and the application was then postponed till next Court day, to allow of this being done. James Holmes, by his agent Mr Seddon, applied for six months’ protection for his interest in extended claim at the Break.—Granted. Donald Chisholm and party, by their agent Mr Hannan, applied for six months’ protection for their double area at Ross Terrace,—Granted for three months. John Burr, by his agent Mr Hannan, applied for a residence area at Mignonette Flat. Postponed at request of applicants. Denis Moynihan, by his agent Mr Hannan, applied for a residence area above Dillraan’s Town.—Postponed at request of applicant. Rudolph Netzband, by his agent Mr Seddon, applied for a residence area on Mignpnette Flat Road.—Granted on the usual conditions. The application of J. S. Pearn and others, as Trustees, to construct a main tail-race, which was objected to by Jus. Dand, John Barnett and party, Reynolds and party, Jones and party, Ciddens and party, Henderson and party, and Lee and party, was again made. The Warden adjourned the Court at 12 noon for the purpose of visiting the ground, and the Court sat again at 3 p.m., when the application was granted on the following conditions : (1.) That the upper extremity of the race is not to be constructed nearer to the Government sludge-channel than 20 feet. (2.) That a condition with reference to the passing through Ciddens and party’s claim be. endorsed on the certificate similar to that imposed on certificate 37073, application 32, 1884. (3.) That the grant be subject to rules and regulations to be hereafter approved by the Warden, according to Regulation 25, Appendix D; and the tail-race not to be used as such until such regulations are approved. (4.) That upon app'ication being made to open into the sludge-channel the Warden may then impose upon the holders of this registration any conditions respecting their use of the tailing reserve, commonly known as the Commonage, which he may think required for the general good. This concluded the business of the Court.
