Bertelsen (Mr E. A. Perritt) claimed from J. F. Montague (Mr, W. J. King) the sum of. £5O which he had lent, with interest thereon from October 22, 1922; Montague counterclaimed for £B9 Is. 3d and £33 solicitor’s fees. Judgment was given for plaintiff for the full amount of claim, £5O with interest at; 7 per cent. down to the date of judgment. The magistrate stated that he was satisfied th*? claim for £B9 Is 3d made by Montague '3vas not owing, and that Montague would fail in respect of that item. The £33 claim was very obscured, and in the meantime he would withhold judgment until further details were received! fr.om Montague.
