AMUSEMENT PERMIT.

POWERS OF LOCAL AUTHORITY. POSITION OF BOROUGH COUNCIL. The question of granting a permit to a travelling show which desired to erect its paraphernalia in a vacant section at Paeroa for a ten davs’ run was considei ed ait the Paeroa Borough Council meeting bn Thursday night. The matter was thoroughly discussed at the Finance Committee meeting on Tuesday night, when it was decided to obtain a legal opinio,n as to whether the council under its bynlaws could refuse to grant a permit. On Thursday night a lengthy opinion from the borough solicitor was fully discussed. The Mayor (Mr ,W. Mai shall) explained that the position briefly was that the council could mot legally refuse to grant a license or charge a greater fee than that prescribed in the. by-laws. He thought it was not wise to allow one’s judgment to be warped. In the sense of British justice he was going to move tlia.t the permit be granted. In seconding, Cr. Flatt said lie had gone carefully into the question and was quite satisfied that the application was ini order, and that the permit should be granted. Cr. Edwards considered that the permit should not be granted’, and he held that it was not in the- betff interests of the people 'that permission should be given.

This view was shared by Cr. Porritt, who said that he was at a loss to understand why other boroughs could refuse to allow the carrying on of such amusements ; and, again, gome boroughs were in a position, to demand very much higher fees. He thought that the dates asked for by the concern were most inopportune. The motion was carried.
