AN ILL-FITTING SUIT.
A TAILOR SUED. i ——- JUDGMENT FOR PLAINTIFF. At the Magistrate’s Court at Wellington on Wednesday, before Mr J. HSalmon, S.M., R. Terrence Rudd, a traveller, claimed £ll fiiOjn A. W. Phipps, a. tailor, of Wellington, on the ground that a suit made by Phipps was useless to him on account of poor workmanship. Plaintiff stated that Phipps had agreed to make a. su ! t for him at a cost of £lO. He paid foir the suit in advance, and added £1 to make sure of a satisfactory job. ,From the outset the suit was unsatisfactoiiy. The coat wafe too tight and the vest and the trousers too short. Phipps 'had agreed that the suit was not satisfactory and’had ailtered it twice. Tift defects, however, were not overcome. Phipps then, offered, to make shim another suit for £6, but. the offer was declined.. Soon aftejr this his solicitor wi'Ote to Phipps and said that 1 e would accept the suit if £7 of the purchase moiiey was refunded. Phipps Would not accept the offer. Defendant’s counsel stated that Rudd had expressed himself as quite satisfied with the coat at the last fitting, but (had asked for alterations to the vest and trouseijs. Later on he said he was satisfied witli the suit, and had gone so far as to tip the foreman tailor.’ Counsel contended that plaintiff had put on weight since suit was finished. That fact would have the effect of spoiling the fit of the suit.- Defendant denied the allegation that he had admitted that the suit was not satisfactory'. The: magistrate said that jt was impossible to believe that plaintiff Was satisfied, with the suit. There was no doubt that the suit was a Shocking fit, and it was-surprising that Phipps d’d not accept plaintiff’s offer.
“As a knock-about suit,” acldelt Mr Salmon, “he might get some va'ue out of it.”
> Judgment for plaintiff for £6 was given, with costs amounting to £2 6s.
