MOTOR LORRY COLLISION
PROSECUTION WINS CASE.
SPENCER CONVICTED AND FINED
Further to the case in which a motor lorry driven by Beeehev Spencer collided with another driven by Alex. Morrison, Hikutaia, proceedings were continued after the luncheon adjournment at the Paeroa Court on Monday afternoon. The accident took place at the intersection of Norwood Road with Thames Road last month. After evidence had been taken the magistrate Mr F. W. Platts, adjourned the case so that lie could make an inspection of the locality. In delivering his verdict the magistrate said that he had had the advantage of inspecting the site. Unde.r the circumstances it was the duty of defendant when approaching the main road to exercise the greatest possible, care, and to give way to approaching traffic from either direction. The business of those entering a main road from a side road was to keep a sharp lookout and proceed with caution. It was evident that defendant had turned into the. main road on his wrong side, and had driven too fast. The. evidence tendered by the defendant had been remarkably frank and truthful. As Mr O’Neill (defendant’s counsel) had pointed out, it had been an error of judgment, and it was fortunate that the collision was not more serious.
Defendant was convicted and finer £l, with costs amounting to £2 18s.
