CLAIM FOR WAGES.
CONFLICTING EVIDENCE.
Further evidence in the case of Ernest Kibble, labourer, Paeroa, v. Short Bros., carriers, the claim being for £4 10s as wages in lieu of notice and also for 54 hours’ overtime was taken before Mr J. H. Salmon, S.M., at the local Magistrate’s Court on Monday. Mr R. S. Carden appeared for plaintiff and Mr E, A. Porritt for the defendants. C. C. Short and his bookkeeper; Miss P. Treanor, were examined in connection with several entries in the firm’s books relative to payments made for wages and overtime. In summing up His Worship said thta there was an extraordinary conflict of evidence, and he was forced to make his own deductions. It was admitted that the parties were not bound by an award, and that the weekly wage paid exceeded that stipulated. The arrangement was a very loose one, and it was probably for a fixed wage to include payment for any overtime worked. Plaintiff seemed to have had time off and to have worked 'Overtime to make it up. On the evidence he could not find that overtime had been worked, and the claim would therefore fail.
On the claim for wrongful dismissal His Worship reviewed the evidence and expressed the opinion that plaintiff was entitled to one week's wages, and he entered judgment for £4 10s only. Costs were £2 Is.
