Huntly J.P. Court.
Messrs E. J. Farrell, and J. Fletcher J’s. P., Presiding. A resident accused of damaging the tent of Alexander Bain, professional athlete andsliowman on the evening of Saturday last. The accused, who pleaded not guilty, was defended by Mr Gregory, Constable Ingram conducting the prosecution. The evidence was' conflicting, and left doubt as to the identity of the person who did the damage. Two witnesses appeared for the prosecution, and four, including the accused, for the defence. The latter were positive that accused was not implicated as he was never out of their sight, while the chief witness on the other side was equally positive that lie was the offender. After considering the evidence, Mr Farrell stated as there was a slight doubt relative to the identity of the defendant, he would receive the benefit, and accordingly dismissed the case, each party bearing his own costs.
